Well it is good job that no-one on this forum has ever cut a tree down because it looks like we are not allowed to . Not on a whim , anyway :

Under Section 37 of the Forestry Act, 1946, it is illegal to uproot any tree over ten years old or to cut down any tree, unless notice of the intention to do so has been given in accordance with the Act.

But it might be ok under one of these exceptions :

The prohibition on the uprooting or cutting down of trees does not apply where:
a) It is a hazel, apple, plum, damson, pear or cherry tree grown for the value of its fruit or any 1ozier;
b) The activity is covered by a felling licence;
c) It is less than 100 feet from a dwelling other than a wall or temporary structure;
d) It is standing in a County or other Borough or an urban district

Where else could it be standing Question

Can anyone clarify ?

you are only telling us now after having me fall down a tree by a master feller ! in between a barn and a tractor ...

Hi my understanding of the felling licence is if you manage a large estate you simply apply for a general licence which is readily granted, or if its an indiviual tree you simply ask your local garda who will grant you a licence.

Probably the most important thing is to make sure the person who is doing the felling is insured!! and their certs are up todate.
There are exceptions to the rule, which the forestry and felling service will talk through with you, most tree fellas will have a general licence.

and Im sure no one has ever cut a tree down not a single one of us or any farmer throughout Ireland and beyond

forgot to mention that most local councils on the west of ireland think its ok to use a digger to flatten a tree or three. funny that!!

Thanks for the input , S&S , but I am still curious to know where a tree might be standing if it isn't " in a County or other Borough or an urban district " . I would have thought that covers the whole country .

And what is the difference between "coppicing" , which I have to do for REPS , and " cutting down " , which I have to do when coppicing ?

I will make a phone call and report back . Wink

I would have thought that Coppicing is done with the view of regeneration and not the total removal of said tree. Watching this space as I have a number of trees to remove.
